A lawyer wouldn’t use the TM symbol unless it was fully signed, sealed and delivered by the Patent and Trademark Office. Takes time and money - so it is probably a joke.

It may be a joke; the TM symbol is to be used for commercial products. However, you do NOT have to register with PTO to use the TM symbol–all the TM symbol does is indicate that you are identifying this word, mark, etc. as a trademark for your product. If you register your trademark with the PTO then you use the circled R symbol to show that it is a registered trademark.
And no, I’m not a lawyer. I only play one on TV.
